By accessing or using the website at brightzapcreations.com or by engaging BrightZap Creations (operated by Bright Flows LLC) for any services, you agree to be bound by these Terms & Conditions.

BrightZap Creations provides web design, web development, and related digital services to businesses and individuals. Our services include but are not limited to:

• Custom website design and development
• Mobile-responsive design
• Basic SEO setup
• E-commerce setup and configuration
• Ongoing website maintenance and support

The specific scope, timeline, and deliverables for each project will be agreed upon in a separate written agreement or proposal before work begins.

Quotes & Proposals: All pricing is provided through a written quote or proposal. Prices are subject to change based on project scope. A quote is valid for 30 days from the date issued.

Deposits: A deposit (typically 50% of the total project cost) is required before work begins. The remaining balance is due upon project completion and before final files or website access are handed over.

Revisions: Each project includes a set number of revision rounds as specified in your proposal. Additional revisions beyond the agreed scope may be billed at our standard hourly rate.

Late Payments: Invoices not paid within 14 days of the due date may result in a pause of services until payment is received.

To ensure a smooth project, clients agree to:

• Provide all necessary content, images, logos, and materials in a timely manner
• Review and provide feedback within the timeframes agreed upon
• Ensure they have the legal right to use any content, images, or materials they provide to us
• Communicate clearly and promptly with our team

BrightZap Creations is not responsible for delays caused by a client's failure to provide required materials or approvals.

Your content: Any content, logos, images, or materials you provide to us remain your property.

Completed work: Once full payment is received, ownership of the final website design and code is transferred to the client. BrightZap Creations retains the right to display the work in our portfolio unless the client requests otherwise in writing.

Our tools & processes: Any proprietary tools, workflows, frameworks, or code libraries developed by BrightZap Creations and used in your project remain the property of Bright Flows LLC.

Third-party assets: Some projects may use licensed fonts, stock images, or plugins. Licenses for these may need to be transferred or purchased separately by the client for ongoing use.

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, Bright Flows LLC, its members, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use our website or services
• Errors, mistakes, or inaccuracies in content
• Unauthorized access to or use of our servers or any personal information stored therein
• Any third-party conduct or content on or linked from our website

Our total liability for any claim arising from our services shall not exceed the amount you paid us for the specific project in question.

We hope to resolve any issue directly and professionally. If you have a concern about our services, please contact us first at Info@brightzapcreations.com and we will make every effort to resolve it within 14 business days.

Mediation: If a dispute cannot be resolved directly, the parties agree to attempt resolution through good-faith mediation before pursuing any legal action.

Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in Austin, Texas, in accordance with the rules of the American Arbitration Association (AAA).

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

Either party may terminate a service agreement with written notice. In the event of termination:

• The client is responsible for payment of all work completed up to the termination date
• BrightZap Creations will deliver all completed work paid for by the client
• Deposits are non-refundable once work has begun

We reserve the right to refuse or discontinue service to any client who violates these terms or engages in abusive, fraudulent, or unlawful behavior.

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law provisions. Any legal disputes not resolved through arbitration shall be brought in the courts of Travis County, Texas.

We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the new terms.
